the legal heirs are divided into three categories: 1) Sharers 2) Residuaries and 3) Distant Kindred.


Father      :  In the absence of child or son’s child,  he becomes a residuary.

Mother       : In the presence of father and husband or wife, 1/3rd after deducting    husband’s or wife’s share.

Wife         :  In the absence of child or son’s child,
her share is 1/4


After deducting 1/4 of the wife’s share the remaining is 3/4.  So the mother gets 1/3 X 3/4 = 1/4 share.


So, the father gets the remaining after the wife and mother get their share of  1/4 each.


So, wife gets 1/4

Mother gets 1/4 (1/3 of 3/4)

Father gets 1/2 (as residuary)

1/4 (wife) + 1/4 (mother) + 1/2 (father) = 1
